Testamentary memorandum: What is it and what is it for?

3 min reading time

The testamentary memorandum is a document that allows us to assign no more than 10% of the total inheritance, including jewelry, clothing, household items, personal belongings, and is also used for directives regarding organs and body. Therefore, it does not require the formalities of a will, and to be valid, it only needs to be authenticated and reference the previous will that it accompanies.  It is recommended that it be handwritten, signed, and dated on all pages.

It is highly recommended to make a very detailed and descriptive list in the testamentary memorandum of all the furniture and furnishings you wish to leave to a specific heir.

If there is no will, the memorandum is not valid, and if there is a will, we must mention the existence of the memorandum in it.
